3. Placing an Order

Our website processes online orders. You can place an order by adding products to your basket and proceeding through the checkout process.

Before submitting your order, you will have the opportunity to review and amend it. Please check your order carefully, including sizes, colours, quantities and delivery details, as we cannot be responsible for any errors you make at this stage.

After you place an order, you will receive an automatic email acknowledging that we have received it. This acknowledgement does not mean that your order has been accepted.

A contract between you and us will only be formed when we send you an order confirmation email stating that your order has been accepted and is being processed, or when we dispatch the products to you, whichever is earlier. We reserve the right to refuse or cancel any order, for example if a product is out of stock, has been withdrawn, or if there is an obvious error in the price or description.

4. Pricing and Payment

All prices on our website are shown in pounds sterling (GBP) and only include UK VAT as applicable, unless otherwise stated. Delivery charges will be shown separately during the checkout process and will may depending on your delivery address and the delivery method selected.

We take reasonable care to ensure that the prices displayed are correct. However, if we discover an error in the price of any product you have ordered, we will contact you as soon as possible to give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled and, if payment has already been taken, provide you with a full refund.

Payment is taken at the time of order through our secure payment providers. We currently accept major credit and debit cards and PayPal as standard payment options. We may add or remove payment methods from time to time.

By providing payment details, you confirm that you are authorised to use the chosen payment method and that there are sufficient funds or credit available to cover the total amount of your order.

5. Delivery

We aim to dispatch orders within the estimated timeframes shown at checkout. Any delivery dates or times given are estimates only and are not guaranteed, although we will always do our best to meet them.

We offer delivery within the United Kingdom and may also offer international shipping to selected countries. Available delivery options, estimated delivery times and charges will be shown during checkout and may vary depending on your location.

Please ensure that the delivery address you provide is complete and accurate. If a parcel is returned to us due to an incorrect or incomplete address, or because it was not collected from a local depot or pick-up point, we may charge additional fees to re-send it.

Risk of loss or damage to the products passes to you when they are delivered to the address you provided, or to any person you nominate to receive them. Ownership of the products passes to you once we have received full payment for them, including all delivery charges.

6. Returns and Refunds

Nothing in these Terms affects your statutory rights under UK law, including your rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Your right to cancel (online purchases)

If you are a consumer (not buying for business purposes), you have the right to cancel your online order for most products within 14 days without giving any reason, in accordance with the Consumer Contracts Regulations 2013. This cancellation period starts the day after you receive the products.

To exercise your right to cancel, you must clearly inform us of your decision to cancel within the 14-day period. You can do this by emailing us using the contact details at the end of these Terms. You may use any cancellation form we provide, but you do not have to.

You must then return the products to us without undue delay and no later than 14 days from the date on which you inform us of your decision to cancel. Unless otherwise agreed, you will be responsible for the cost of returning the products.

Condition of returned products

Products should be returned in their original condition, unused, unwashed and with all original tags, labels and packaging intact, unless they were faulty or misdescribed when you received them. We may make a deduction from any refund for any loss in value of the products if this has been caused by unnecessary handling by you beyond what is reasonably necessary to inspect the nature, characteristics and functioning of the goods (for example, more than you would be allowed to do in a shop).

For hygiene reasons, we may not be able to accept returns of certain items that have been worn or used, unless they are faulty. Any such restrictions will be clearly explained on the product page where applicable.

Refunds

Once we receive your returned products, we will inspect them and process your refund as soon as reasonably possible and in any event within 14 days of the date we receive the products back (or, if earlier, the date on which you provide evidence that you have sent the products back).

Where you cancel your order in accordance with your statutory rights, we will refund you the price you paid for the products, including the basic cost of standard delivery. If you chose a more expensive delivery option (for example, express or next-day delivery), we will only refund what it would have cost to deliver the products by our least expensive standard delivery option.

Refunds will be made using the same payment method you used for the original transaction, unless we have expressly agreed otherwise. You will not incur any fees as a result of the refund.

Your rights if products are faulty, not as described or not fit for purpose are set out in the Consumer Rights Act 2015. If you believe a product is faulty or misdescribed, please contact us as soon as possible so that we can resolve the issue in line with your legal rights.

7. Products

We take care to ensure that the descriptions and images of our products on the website are accurate and up to date. However, slight variations in colour, texture or finish may occur due to differences in display settings or manufacturing processes. Such minor variations will not mean that a product is faulty or misdescribed.

All products are subject to availability. If a product you have ordered is unavailable, we will contact you as soon as reasonably possible to offer an alternative, a revised delivery time, or a refund for the unavailable item.

If we offer digital gift cards or physical gift vouchers from time to time, additional terms may apply to their purchase and use, including any expiry dates, restrictions on use and whether they can be exchanged or refunded. Any such terms will be made clear at the point of purchase.

8. Intellectual Property

All content on this website, including but not limited to text, graphics, logos, photographs, product images, designs and layout, is owned by or licensed to Creative Hats Press and is protected by copyright, trade mark and other intellectual property laws.

You may use our website for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store or transmit any of the material on our site without our prior written consent, except as permitted by law.

You must not use any part of the content on our website for commercial purposes without obtaining a licence to do so from us or our licensors.

9. Limitation of Liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter for which it would be unlawful for us to exclude or limit our liability under UK law.

If you are a consumer, we are responsible to you for loss or damage you suffer that is a foreseeable result of our breaking these Terms or our failing to use reasonable care and skill. We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen.

We only supply the products for domestic and private use. If you use the products for any commercial, business or re-sale purpose, we will have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

We do not guarantee that our website will always be available or be uninterrupted, and we will not be liable for any loss you may suffer as a result of any temporary unavailability or technical issues, except where required by law.

10. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of England and Wales.

If you are a consumer resident in the UK, you and we both agree that the courts of England and Wales will have exclusive jurisdiction, except that if you are a resident of Scotland or Northern Ireland, you may also bring proceedings in your local courts.

11. Changes to These Terms

We may update or amend these Terms from time to time, for example to reflect changes in our business practices, products, services or legal requirements. When we do so, we will post the updated Terms on this page and update the “Last updated” date at the top.

Any changes will apply to new orders placed and to use of the website after the date on which the updated Terms are posted. If you continue to use the site or place an order after the Terms have been updated, you will be deemed to have accepted the revised Terms.
